Malpractice, Negligence & Documentation
Malpractice needs all four elements — duty, breach, causation, damages; EMTALA requires a screening exam and stabilization for everyone who comes to the ED.
To win a malpractice (negligence) claim the plaintiff must prove all four elements: a duty to the patient, breach of that duty (care below the standard), causation of the harm by the breach, and damages.
EMTALA requires a Medicare-participating hospital with an emergency department to give anyone who comes there an appropriate medical screening exam, regardless of ability to pay, to determine whether an emergency medical condition exists.
If an emergency medical condition exists, the hospital must stabilize it within its capability or make an appropriate transfer; screening and stabilizing care may not be delayed to ask about payment or insurance.
